Terms of Service

These terms govern your access to and use of Stratamize LLC's marketing website and products. By using the site or our software, you agree to these terms.

1. Acceptance of these terms

By accessing this website or using any Stratamize product, you agree to be bound by these Terms of Service and by our Privacy Policy. If you are using the services on behalf of a business, you represent that you are authorized to bind that business to these terms. If you do not agree, do not use the site or the services.

2. Who we are

Stratamize LLC ("Stratamize", "we", "us", "our") is a US-based software company headquartered in Newnan, Georgia. We build operator-grade software for businesses that run on hardware and payments: vending, point of sale (POS), CRM, voice AI, and automations.

3. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the services. Where you create an account, you are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • Use the services for any unlawful purpose or in violation of any applicable law or regulation, including telephony, messaging, and age-restricted-sales rules.
  • Interfere with, disrupt, probe, or attempt to gain unauthorized access to the services or related systems.
  • Reverse engineer, resell, or sublicense the services except as expressly permitted in a written agreement with us.
  • Upload or transmit malicious code, or use the services to send unsolicited, fraudulent, or abusive communications.

5. Operator responsibilities

If you use our software to run your business, you are responsible for the lawful operation of your business and for the accuracy of the configuration and content you provide — including your hours, pricing, knowledge base, call scripts, and consent disclosures. You are responsible for obtaining any consents your jurisdiction requires for call recording, SMS, and age-restricted sales, and for complying with all laws that apply to your business and your customers. We provide tooling to support compliance; we do not provide legal advice.

6. SMS, calls & recordings

Where you enable text messaging or AI call handling, the SMS Terms and Privacy Policy apply, and you agree to use those features only in a consent-aware, lawful manner. Calls handled by our voice-AI service may be recorded and transcribed to produce summaries and an audit trail; you are responsible for any caller disclosures your jurisdiction requires. Message and data rates may apply; reply STOP to opt out and HELP for help.

7. Payments & fees

Fees, billing cycles, and payment terms for any paid product are set out in the order or agreement you enter with us. Unless stated otherwise, fees are non-refundable and are exclusive of taxes, which are your responsibility. Card payments are processed through PCI-compliant partners; we do not store full payment card numbers on our own systems.

8. Intellectual property

The site, the software, and all related content, trademarks, and design are owned by Stratamize or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the services as permitted by these terms or a separate agreement. You retain ownership of the data and content you submit, and you grant us the rights needed to operate the services for you.

9. Third-party services

The services integrate with third-party providers — for example, telephony and messaging carriers, identity-verification providers, payment processors, and cloud hosting. Your use of those services may be subject to their own terms, and we are not responsible for third-party services outside our control.

10. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that message or call delivery is guaranteed.

11. Limitation of liability

To the maximum extent permitted by law, Stratamize will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the services. Our total liability for any claim relating to the services is limited to the amount you paid us for the services in the twelve months before the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Stratamize and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the services, your content or configuration, or your violation of these terms or applicable law.

13. Term & termination

These terms apply while you use the services. We may suspend or terminate access if you violate these terms, create risk or legal exposure, or as otherwise set out in your agreement with us. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

14. Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Georgia will have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have where you live.

15. Changes to these terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the site or services after an update means you accept the revised terms.
